THESE PETITIONS, COMING ON FOR FINAL HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners common in both petitions are before this Court calling in question registration of crimes in Crime Nos.466/2024 and 469/2024, both pending before the XXIV Additional Chief Metropolitan Magistrate, Bengaluru, both for the offences under - 5 - HC-KAR NC: 2026:KHC:13424 CRL.P No. 2052 of 2025 C/W CRL.P No. 2021 of 2025 Sections 318 and 351 of the BNS, 2023. Complainants in both petitions are different. 2. Learned counsel for the petitioners and respondent No.2 in both petitions would in unison submit that during the pendency of these proceedings, the parties to the lis have settled their disputes amicably by certain terms and conditions. Therefore, the parties file applications under Sections 359 r/w. 528 of the BNSS with supporting joint affidavits before this Court seeking permission to compound the offences. 3. The joint affidavit filed in Crl.P.No.2052/2025, reads as follows: “1. I state that Petitioners herein along with myself i.e. Respondent NO.2 are filing this joint Affidavit as follows. 2. I state that the Petitioners approached this Hon'ble Court, questioning the validity and correctness of the acts of the Respondent No 1 Police in registration of FIR In Crime No. 0466/2024 arising out of PCR No. 14156/2024 registered by the Respondent No.1 Basaveshwara Nagara PS for the offences punishable under section 318 and 351 of BNS, 2023, pending on the file of XXIV Addl. CJM, Bengaluru, seeking quashing of the same and all further proceedings arising thereto. 3. That during the pendency of the same, at the intervention of well wishers and family members of - 6 - HC-KAR NC: 2026:KHC:13424 CRL.P No. 2052 of 2025 C/W CRL.P No. 2021 of 2025 both the Petitioners and me, the Respondent No.2 herein, we have decided to amicably settled the matter. 4. I undertake that the Petitioners has paid a total sum of Rs. 8,00,000/- (Rupees Eight Lakhs Only) to me vide Cheque bearing No. 10045294 dated 27.01.2026 drawn at The Federal Bank, Ramanagara Branch,, Ramanagara, Bengaluru Rural-571511. 5. I state that the Petitioners herein have paid remaining sum of Rs. 8,00,000/- in the following manner: a. Rs. 2,50,000/-(Rupees Two Lakhs Fifty Thousand Only) vide Demand Draft bearing No. 680645, dated 23.02.2026, drawn on Federal bank, Ramanagara Branch. b. Rs. 3,50,000/-(Rupees Three Lakhs Fifty Thousand Only) vide Demand Draft bearing No. 680646, dated 27.02.2026, drawn on Federal bank, Ramanagara Branch. c. Rs. 2,00,000/-(Rupees Two Lakhs Only) by way of Cash. Thus, I acknowledge that I have received a total sum of Rs. 16,00,000/- (Rupees Sixteen Lakhs Only) from the Petitioners towards full and final settlement of all disputes, claims and allegations arising out of Crime No. 0466/2024. It is hereby mutually agreed between the Petitioners and Respondent No.2, and the same is placed on record, that in the event the Demand Draft issued by the Petitioners is returned unpaid or dishonoured, or otherwise not realised for any reason whatsoever, Respondent No.2 shall initiate appropriate action against the Petitioners in accordance with law. 6. I state that in consideration of the aforesaid settlement amount, I hereby declare and undertake - 7 - HC-KAR NC: 2026:KHC:13424 CRL.P No. 2052 of 2025 C/W CRL.P No. 2021 of 2025 that neither I, being Respondent No.2 herein, nor any of my family members, legal heirs, representatives or persons claiming through or under me, shall hereafter initiate, pursue or continue any civil or criminal proceedings, complaints, claims or actions of whatsoever nature against the Petitioners in respect of the subject matter of the aforesaid FIR. 7. I state that I have no objection to the case being as the and consequently quashed compounded Petitioners herein have amicably settled the matter. WHEREFORE, having settled the matter the Petitioners and I myself, pray that this Hon'ble Court maybe pleased to permit us to compound the instant case and consequently quash the Fir in Crime No. 0466/2024 arising out of PCR No. 14156/2024 registered by the Respondent No.1 Basaveshwara Nagara PS for the alleged offences punishable under section 318 and 351 of BNS, 2023, pending on the file of XXIV Addl. CJM, Bengaluru in the interest of justice and equity. An identical joint affidavit is filed in Crl.P.No.2021/2025 is filed indicating Crime No.469/2024. For the aforesaid reasons, I pass the following: ORDER (i) The criminal petitions are disposed.
