HIGH COURT OF JUDICATURE AT ALLAHABAD MATTERS UNDER ARTICLE 227 No. - 14151 of 2026 Court No. - 9 HON'BLE ROHIT RANJAN AGARWAL, J. 1. This is a defendants' petition. Plaintiff-respondent filed a suit for permanent injunction for restraining the defendant-petitioners from interfering in the suit property mentioned in the plaint. An application 8C2 was moved for granting temporary injunction, in which, ad-interim injunction was granted on 28.5.2019 and notices were issued to the defendants. 2. According to the defendants' counsel, at the interim stage, final relief has been granted, which the trial court could not grant as the suit was for permanent injunction. 3. Shri D.R. Chaudhary, counsel appearing for the plaintiff-respondent submitted that the order impugned is of the year 2019 and the defendants are not appearing before the court below, which can be clearly seen from the order sheet. 4. I have heard the counsel for the parties and perused the material on record. 5. It is an admitted fact that the present writ petition is highly time-barred as the order impugned is of the year 2019. However, as final relief has been granted while considering the interim injunction application and only an ad-interim injunction has been granted and the application 8C2 is still pending consideration, the order impugned is hereby set aside. The matter is remitted back to the trial court. The trial court is directed to positively decide the application 8C2 filed by the plaintiff within one Versus Counsel for Petitioner(s) : Raj Kumar Dhama Counsel for Respondent(s) : Rajeev Gupta And 2 Others .....Petitioner(s) Rahul Jain And 3 Others .....Respondent(s) month from the date of production of a certified copy of this order, after hearing both the affected parties. It is made clear that no adjournment would be granted to either of the parties. 6. For a period of one month, parties to maintain status quo over the property in dispute. 7.
