Petitioner -- Versus -- The State of Jharkhand .... Opposite Party ---- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioners :- Mr. L. C. N. Shahedeo, Advocate For the State :- Mr. Nawin Kr. Singh, A.P.P. Mr. Shailesh Kumar Sinha, A.P.P. ---- 03/13.05.2026 Both these Anticipatory Bail Applications arise out of same F.I.R. Accordingly, both these Anticipatory Bail Applications are being heard together. 2. Heard learned counsel for the petitioners and learned counsel for the State. 3. The petitioners are apprehending their arrest in connection with Bhawnathpur P.S. Case No. 193 of 2025, for offence registered under sections 103(1)/61(2) of the Bharatiya Nyaya Sanhita, 2023, pending in court of learned J.M.F.C., Nagar Untari at Garhwa. 4. Learned counsel for petitioners submits that in the F.I.R., it has been alleged that the petitioner Mina Devi was in relationship with one Ram Naresh Yadav and the deceased has seen both these petitioners in compromising position and thereafter, the petitioners strangulated her and murdered her. He submits that as per the Neutral Citation No. (2026:JHHC:14977) --2-- F.I.R. it was alleged to be seen in presence of the son namely Dharmendra Choudhary where they were in such a position. He submits that it is unbelievable that in presence of son, such thing will happen. On these grounds, he also submits that anticipatory bail may kindly be granted. 5. Learned counsels appearing for the State in the respective cases jointly oppose the prayer and submits that there is direct allegation of strangulation of the deceased and throwing the dead body in the field. They also submit that it has come in the case diary that petitioners Mina Devi and Ramnaresh Yadav, were in relationship. On the allegation of strangulation, the material is also there against them. On these grounds, they submit that anticipatory bail may kindly be rejected. 6. Considering that F.I.R. is not an encyclopedia, in the investigation, it has been revealed that these petitioners were in relationship and they were caught red-handed by the deceased and they have strangulated her. 7. In the attending facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioners, hence, the prayers for anticipatory bail of the petitioners are hereby rejected.
