At the outset, Mr. Abhimanyu Singh Khatri, counsel for the Petitioner, submits that prayer (b) is not pressed, as the DDA has not disturbed the Petitioner’s possession of the subject land. He submits that the Petitioner shall avail of appropriate remedies in accordance with law, if the need so arises. 2. Issue notice. Ms. Shobhana Takiar, SC for DDA, and Mr. Lalltaksh Joshi, counsel for GNCTD, accept notice. 3. The Petitioner claims ownership and possession of land bearing Khasra No. 57/11/3 (1-0), situated at Village Mamurpur, Narela, Delhi. The grievance of the Petitioner is that despite repeated requests for demarcation of the subject land, the same has not been carried out. It is stated that although this Court, in an earlier round of litigation, had directed the DDA This is a digitally signed order. The Order is downloaded from the DHC Server on 27/07/2026 at 15:40:17 to consider the Petitioner’s request for demarcation, the DDA, by order dated 14th May, 2025, declined to undertake the demarcation on the ground that it lacked jurisdiction to do so. 4. It is the Petitioner’s grievance that the DDA has taken the stand that it is not competent to carry out demarcation of privately owned land, whereas the Revenue Authorities have also declined to undertake the exercise on account of the village having been urbanised under Section 507 of the Delhi Municipal Corporation Act, 1957. Consequently, a jurisdictional ambiguity has arisen as to whether the demarcation is to be undertaken by the DDA or the GNCTD. 5. As far as this aspect is concerned, in Luv Nagpal & Anr. v. Govt. of NCT of Delhi1, this Court directed the GNCTD and the DDA to conduct the demarcation exercise jointly in the presence of the petitioners or their representatives, so that the process is not held up pending resolution of the jurisdictional issue. 6. The same approach has been followed in subsequent decisions, including Rajender Singh & Anr. v. SDM Revenue Assistant Mehrauli2. 7. Counsel for the Respondents submit that the present petition may also be disposed of on similar terms. 8. Mr. Khatri, counsel for the Petitioner, submits that the Petitioner is willing to bear the expenses for carrying out the demarcation exercise. Accordingly, and having regard to the fact that the DDA is also a party to the present proceedings, the writ petition is disposed of with a direction that the demarcation exercise in respect of the subject land shall be carried out 1 W.P.(C) 13567/2025, decided on 03rd September, 2025. 2 W.P.(C) 14600/2025, decided on 08th October, 2025. It is made clear that the aforesaid directions shall remain subject to any orders passed by the Full Bench in O.REF. No. 1/2024, titled State on its Own Motion v. NEMO. It is further clarified that this order is passed without prejudice to the rights and contentions of the GNCTD and the DDA in the said reference. 10.
