06.01.2026 Court No.28 Item No.25 tbsr Reject CRM (A) 3967 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Balurghat P.S. Case No. 603 of 2024 dated 30.07.2024 under Sections 64/62/3(5) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 8/18 of the Protection of Children from Sexual Offences Act. And In the matter of: Bidush Barman ….Petitioner. Mr. Kaushik Choudhury Mr. Dwaipayan Panda Mr. Tridib Das …for the petitioner Mr. Pravash Bhattacharya Ms. Trisha Rakshit ….for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. The principal accused was arrested and was thereafter granted bail. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the materials available in the case diary including the FIR and the statements made by the victim before the learned Magistrate. It appears that the petitioner had remained absconding for a long time as the case was registered in July, 2024. Considering the above and the other incriminating materials available in the case diary and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. 2 The personal appearance of the Investigating Officer is noted and is dispensed with. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
