In this writ petition, the petitioner-Judgment Debtor has called in question the order dated 03.05.2025 passed by the II Additional Civil Judge and JMFC, Mandya (hereinafter referred to as ‘Trial Court’ for short) in Ex.No.107/2023 on I.A.No.VII filed by the respondent- Decree Holder under Order XXVI Rule 9 read with Section 151 of CPC vide Annexure-A, whereby, the said application filed by the Decree Holder has been allowed. - 3 - HC-KAR NC: 2026:KHC:15281 WP No. 5699 of 2026 2. The operative portion of the impugned order dated 03.05.2025 is reads as follows: “ORDER The I.A.No.VII filed by the Decree Holder under order 26 rule 9 R/W/Sec.151 of C.P.C is hereby allowed. The court commissioner is hereby directed to capture the entire proceedings through Video graphy through Camara from beginning to end, at the time of doing the commissioner work by breaking open the lock of the Almirah and also submits the same accordance with law. The court commissioner fee is tentatively fixed at Rs.2,000/-. The court commissioner shall submit his report to the court by next date of hearing. Issue commissioner warrant: Await report by 13.06.2025.” 3.
