Bora, learned Senior Central Government Counsel for the opposite party- respondent nos. 1, 2 & 3; and Mr. B. Hazarika, learned counsel for the opposite party-respondent no. 4. 2. The instant interlocutory application is filed by the applicant-writ petitioner in the spirit of Order VI Rule 17 of the Code of Civil Procedure, 1908 seeking amendment in the Cause-Title of the accompanying writ petition. 3. The applicant as the writ petitioner has preferred the accompanying writ petition, W.P.[C] no. 1599/2024 against two orders, DPIIT Order no. P 14031/9/2023 and DPIIT Order no. P 14031/21/2023. 4. In the instant application, it is stated that during pendency of the accompanying writ petition, the Guwahati Branch Office of the applicant-writ petitioner has been shifted to a new address, pursuant to an Order dated 10.02.2026 passed by the Municipal Secretary, Guwahati Municipal Corporation. In respect of the plot of land where the Guwahati Branch Office of the applicant- writ petitioner has been shifted, the name of the petitioner company has already been mutated. 5. The applicant-writ petitioner has sought that in place of its earlier description of the Guwahati Branch Office in the Cause-Title of the
Page No.# 3/4 accompanying writ petition, its descriptions are to be inserted as under :-
“EXIMCORP INDIA PRIVATE LTD.
A company registered under the Indian Companies Act, 1956 and having its registered office at 25 RN Mookherjee Road, Kolkata – 700 001, and having its Guwahati Branch office address at Flat Nos. 105 and 106, Surya Vatika Apartment, Block-B, Pine Tower, A K Deb Road, Dhirenpara, Guwahati-781025, Assam, in the instant case the petitioner company is represented by Mr. Wairok Hangshing Maring”
instead of –
“EXIMCORP INDIA PRIVATE LTD. A Company registered under the Indian Companies Act, 1956 and having its registered office at 25 RN Mookherjee Road, Kolkata – 700 001, one of its warehouse at 845, Pub Boragaon, Jalukbari, Garchuk, District – Kamrup [Metro], Guwahati – 781035, Assam, in the instant case the Petitioner company is represented by Mr. Wairok Hangshing Maring.”

The learned counsel appearing for the opposite parties-respondents have raised no objection to the averment made by the applicant-writ petitioner made in the application that such amendment is not going to change the nature and character of the case set up in the accompanying writ petition. 7. This Court is of the view that the amendment as sought for, and indicated above, is not going to change the nature and character of the case set up by the applicant-writ petitioner in the accompanying writ petition. Hence, the instant application is allowed. 8. The learned counsel for the applicant-writ petitioner shall take appropriate steps to carry out the amendment in the accompanying writ petition.
