JUSTICE PRANJAL DAS O R D E R 27.08.2026 Heard Mr. A. Tiwari, learned counsel for the petitioners. Also heard Mr. K. Baishya, learned Additional Public Prosecutor. 2. This petition under Section 482 BNSS is filed by the petitioners, namely, Salim Uddin and Hussain Ahmed, apprehending arrest in connection with Changsari P.S. Case No. 201/2025 registered u/s 303(2)/317(2) of BNS. 3. The case arose out of the FIR dated 10.10.2025. The gist of the allegation is that two trucks bearing Registration Nos. TR03-M-1618 and NL-01-AE-0551 were found parked near Brahmaputra Industrial Park, Gauripur and upon search, suspected Areca Nuts belief to be of Burmese origin in large quantity were found in a hidden compartments in the roofs of both the trucks. 4. It is alleged that those are stolen materials and being transported illegally. 5. This is a subsequent bail petition, as the earlier bail petitions were rejected on 12.12.2025 and 18.12.2025. 6. The learned counsel submits that in the meantime, the petitioners, who are the owners of the vehicles mentioned above have been granted zimma/interim custody of the vehicles by the Court of the learned Magistrate, but they have not been able to take the vehicles because of the pendency of the case and not being under the protection of anticipatory bail. 8. The petitioners were granted interim bail on 19.08.2026 and updated Page No.# 3/3 case diary called for, which is received. 9. Mr. Baishya, learned Addl. P.P., fairly submits that they have appeared before the IO and contended in their statement that they were not aware of any offences connected to the trucks which were owned by them. Investigation is also stated to have progressed. 10. In the given facts circumstances, it would be just and proper to make the interim bail absolute at this stage. Accordingly, the interim bail dated 19.08.2026 is hereby made absolute with the conditions that:- (i) The petitioners cooperate with the remaining investigation and abide by the process of law. 11.
