For Petitioner(s): MR.SURESH for M/S.Shivakumar and Suresh For Respondent(s): Mr.N.R.R.Arun Natarajan For R1 To R4 COMMON ORDER The revision petitioners have filed these petitions to set aside the order passed in MP No.10 of 2026 in RCOP No.1550, on the file of the XV Small Causes Court, Chennai, dated 06.04.2026. 2. Before the trial Court, the legal heirs of the deceased second respondent filed an application to implead themselves in the R.C.O.P. proceedings in order to continue the eviction proceedings, stating that there is a dispute among the legal heirs and they intend to prosecute the matter. The said application was dismissed by the learned trial Judge on the ground that it was filed only to prolong the proceedings. Aggrieved by the same, the present revisions have been filed. https://www.mhc.tn.gov.in/judis CRP No. 2357 of 2026 3. The learned counsel for the revision petitioners submitted that the legal heirs of the deceased Prakash are necessary parties to the proceedings and their presence is required to effectively prosecute the case. 4. Per contra, the learned counsel for the landlord/respondents submitted that the R.C.O.P. was filed in the year 2015 and for nearly 10 years the tenants have been in occupation without paying rent and have been prolonging the proceedings by filing various applications. 5. Considering the submissions on both sides, it is seen that the R.C.O.P. for additional accommodation was originally filed against Prabhu and Prakash. Prabhu, who is the son of Prakash, is already on record and is conducting the proceedings. Upon the death of Prakash, other legal heirs sought to implead themselves. However, one of the legal heirs is already on record and the other legal heirs had remained ex parte. 6. At the stage of arguments, the tenants have come forward with the present application, which is not maintainable. The reasoning given by the learned trial Judge does not warrant interference. Further, the proceedings have https://www.mhc.tn.gov.in/judis CRP No. 2357 of 2026 been pending for nearly 10 years, and the conduct of the petitioners indicates an attempt to delay the matter, shall not be encouraged. 7. Accordingly, the Civil Revision Petitions are dismissed. Consequently, the connected miscellaneous petitions are closed.
