The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, the Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus directing the respondents to grant promotion to the petitioner from the post of Assistant Food Officer to Food Officer/Assistant Director under the 3% horizontal Persons with Disabilities quota, in accordance with 2 the GAD circulars dated 26.02.2014 and 29.08.2016 and 30.10.2025, with retrospective effect from the date of eligibility, along with all consequential benefits including seniority, arrears of pay, and other allowances. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondents to calculate and fill the backlog vacancies for PwD promotions in the Food, Civil Supplies and Consumer Protection Department as per the 100-point roster system, and prioritize the petitioner's case accordingly. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief, as it may deems fit and appropriate.” 2. Learned counsel for the petitioner submits that the petitioner was not granted promotion on the post of Food Officer against which, he has submitted representation before the Respondents No. 1 & 2 which till date is pending consideration and therefore, direction be issued to the Respondents No. 1 & 2 to consider and take decision on the representation submitted by the petitioner at the earliest. 3. On the other hand, learned counsel for the Respondents/State submits that as the petitioner is not pressing this writ petition on merits and is only seeking a direction to the respondents to take decision on the representation, she is having no objection in view of the limited prayer made by the counsel for the petitioner. If the representation is still pending consideration, it will be considered and decided in accordance with law. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, without entering into the merits of the claim of petitioner, this writ petition at this stage is disposed of directing the Respondents No. 1 & 2 to consider and take decision on the pending representation submitted by the petitioner in accordance with law expeditiously, 3 preferably within a further period of 03 months from the date of receipt of the order. 6.
