R B BORA BEFORE HONOURABLE MR. JUSTICE ARUN DEV CHOUDHURY ORDER 24.08.2026 1. Heard Mr. A. Hussain, learned counsel for the petitioner. Also heard Ms. N. Choudhury, learned Standing Counsel for the BTC. 2. The present contempt petition is filed alleging willful and deliberate violation of this Court’s order dated 29.05.2024 passed in WP(C) No. 2741/2024. 3. By the aforesaid order, the Principal Secretary, BTC, Kokrajhar was directed to consider the representation filed by the petitioner and dispose of the same within a period of two months from the date of receipt of the application. 4. The petitioner claims to be 1st wife of Late Sattar Ali, who was serving as a Tax Collector under Gossaigaon Mahkuma Parishad in the Kokrajhar district, Assam. 5. The matter was finally placed before the Director of Panchayat & Rural Development, BTC, Kokrajhar, who conducted a hearing in his office in Page No.# 3/3 presence of the Secretary, Gossaigaon and Kokrajhar Mahkuma Parishad, the Accountant of Gossaigaon Mahkuma Parishad, one Grade-IV employee and three wives of Late Sattar Ali, which includes petitioner Jamila Bibi, and two others namely, Sabijan Bibi and Misran Bibi. 6. After hearing, the authorities passed a speaking order dated 10.04.2025, relegating the petitioner as well as other two wives of Late Sattar Ali to approach the appropriate authority i.e. the office of the Commissioner, P&RD, Assam, for grant of family pension and other pensionary benefits. 7. In view of the aforesaid, the direction issued by this Court under its order dated 29.05.2024 passed in WP(C) No. 2741/2024 has been complied with. 8. It is needless to say that the petitioner shall be at liberty to assail the speaking order dated 10.04.2025 passed by the Director of Panchayat & Rural Development, BTC, Korajhar, if so advises, or may approach this Court once again, if fresh cause of action arises inasmuch as it is the case of the petitioner that subsequently, the Commissioner, P&RD, Assam, has sought a proposal for family pension from the BTC authority, however, same has not been sent. 9.
