Chirkunda, District Dhanbad, Jharkhand. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Ram Prakash Singh, Advocate For the Respondent(s) : Mr. Manish Kumar, Advocate ------ 02/ 12.05.2026 By filing this writ petition, the petitioner has prayed for the following reliefs:- "(i) For issuance of a writ, particularly a writ in the nature of mandamus for an earliest execution of the order dated 10.02.2022 passed in Maintenance and Welfare of Parents and Senior Citizen Case No.01 of 2021 as contained in Annexure-1 of the writ application passed by Respondent No.3 which has been affirmed by Respondent No.2 in Senior Citizen Appeal Case No.02/2022 confirming the order of eviction dated 10.02.2022 passed by Sub-Divisional Officer- cum-President under Maintenance and 2026:JHHC:14540 2 Welfare of Parents and Senior Citizen Forum, Dhanbad as contained in Annexure-2 vide order dated 29.03.2023. (ii) Petitioner further prays for issuance of an appropriate order/ direction, directing the Respondent No.3 to take immediate step for restoring the possession of the premises to the petitioner over the building situated at Sharda Mension, S.B.I. Building G.T. Road, P.O. and P.S. Chirkunda, District Dhanbad to the rightful owner from the illegal possession of Respondent Nos.4 and 5." 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. It is the grievance of the petitioner that order dated 10.02.2022 passed in Maintenance and Welfare of Guardian and Senior Citizen Case No.01/2021, by the Sub-Divisional Officer- cum-Chairman, Sub-Divisional Level, Guardian and Senior Citizen Maintenance Tribunal, Dhanbad (Annexure-1 to the writ petition), is not being executed in spite of best effort of the petitioner. 4. Learned counsel representing the petitioner submits that the petitioner has approached respondent No.2 - Deputy Commissioner, Dhanbad, but the Deputy Commissioner is not taking any steps. 5. Considering the aforesaid submission, since the petitioner is an old lady and the order is under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, I direct respondent No.2 - Deputy Commissioner, Dhanbad, to ensure 2026:JHHC:14540 3 execution of order dated 10.02.2022 passed in Maintenance and Welfare of Guardian and Senior Citizen Case No.01/2021, if it has attained finality. 5.1. The Deputy Commissioner, Dhanbad, should ensure compliance within four weeks from today. 5.2. It is expected that the petitioner will produce a copy of order of this Court, before the Deputy Commissioner, Dhanbad, within ten days. 6.
