BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER 26.08.2026 Heard Mrs. K. Devi, learned counsel appearing for the petitioner as well as Mr. R. J. Baruah, learned Additional Public Prosecutor, Assam. 2. This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Binoy Roy, has prayed for bail in connection with Golakganj P.S. Case No. 59/2026 u/s 69/351(3) of BNS, 2023 r/w Section 67A IT Act, 2000 (corresponding to GR No. 256/2026).The petitioner was arrested on 10.03.2026. Page No.# 2/3
3. The FIR was lodged on 07.06.2026 by the alleged victim girl stated that her age 23 years. It is alleged in the FIR that she developed a romantic relationship with the petitioner followed by some physical relationship and that, the petitioner gave her false assurances of marriage. It is also alleged that the family members of the petitioner subjected her to physical and mental cruelty and unable to bear the same, she returned to her home. The informant has alleged about the petitioner uploading of her private photos and videos on social media and that he has been pressurizing her for physical relations. 4. The earlier bail petition was rejected by this Court on 24/6/2026 in BA 1574/26. 5. The updated scanned TCR is received. 6. The case is at the stage of evidence and as of now some of the witnesses have been examined including the victim girl who has been examined as PW-1. She is also the informant of the case. I find from the scanned record that four witnesses have been examined so far. 7. In view of the length of detention and the progress of trial, I am inclined to allow the bail at this stage subject to suitable conditions to address any concerns regarding safety and welfare of the victim. 8.
Accordingly, it is provided that the accused petitioner named above, shall be released on bail of Rs.50,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall be available for the trial; (b) shall not hamper or tamper with evidence;
Page No.# 3/3 (c) shall not in any manner cause any annoyance, harm, harassment or intimidation upon the victim cum informant; (d) shall not commit any offence or illegal activity pertinent to the victim vis-à-vis electronic or other medium
9. Violation of the bail conditions will entail cancellation of the bail petition. 10. It is reiterated that the I/O of the case shall engage with the cybercrime authorities of police and do the needful so that the private photographs or video, if any of the victim girl are no longer available on the internet/social media, if not done already. 11.
