Mr. Soumitra Baroi, Adv. ---- 07/Dated: 14th May, 2026 1. The present appeal has been filed under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. 2. Heard learned counsel for the appellants, learned counsel for the State and learned counsel for the victim. 3. The present criminal appeal, filed in the nature of an application for anticipatory bail, is directed against the impugned order dated 14.07.2025 passed by the learned A.J.C.-II-cum-Special Judge SC/ST Act, Ranchi in A.B.P. No.1319 of 2025 arising out of Sukhdev Nagar (Pandra O.P.) P.S. Case No.32 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 109, 324(4), 324(5), 352, 118(1), 351(2)(3) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and under Section 3(1)(r)(s) of the SC/ST (PoA) Act, which is presently pending before the court of the learned A.J.C.-II-cum-Special Judge SC/ST Act, Ranchi. 4. Although Section 18 of the SC/ST (PoA) Act bars the grant of anticipatory bail, such embargo would not apply where no prima facie offence under the provisions of the Act is made out. 5. Learned counsel for the appellants has submitted that the appellants had recently purchased a new car and, in order to avoid scratches, they were cutting the 2026:JHHC:14826 Page | 2 Criminal Appeal (S.J.) No.1056 of 2025 bushes alongside the road leading to their house. It has been contended that the victim objected to the same, which led to a minor scuffle between the parties, and thereafter the present case under the SC/ST (PoA) Act has been falsely instituted. As per the allegation only caste name has been used which cannot attract the SC/ST (PoA) Act. On the aforesaid grounds, prayer for anticipatory bail has been made. 6. Learned counsel for the victim has opposed the prayer for bail and it has been submitted that since he has been abused and assaulted by the appellants and as such the SC/ST (PoA) Act gets attracted. 7. Learned counsel for the State has opposed the prayer of the appellants and has submitted that the injuries are simple in nature and the appellants have also criminal antecedent. 8. It has been submitted by the learned counsel for the appellants that in the alleged criminal case the appellants have already been released on bail. 9. Considering the fact that there is simple scuffle between the parties over clearing the bushes, the appellants, above named, are directed to surrender in the court below within four weeks from the date of receipt/ production of the copy of this order and in the event of their arrest or surrender, they shall be enlarged on bail, on their furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned A.J.C.-II-cum-Special Judge SC/ST Act, Ranchi in connection with Sukhdev Nagar (Pandra O.P.) P.S. Case No.32 of 2025 on the conditions as laid down under Section 482 B.N.S.S., 2023. Further, the appellants will submit self-attested photocopy of their Aadhaar Cards and also submit their mobile numbers before the learned court below which they will always keep active and will not change it during pendency of this case without prior permission of the court. 10. In the result, the instant appeal stands allowed and disposed of. (Rajesh Kumar, J.) Dated: 14th May, 2026 Amar/- Uploaded on 15.05.2026
