GP FOR REVENUE The Court made the following: 2 ORAL ORDER: Heard Sri Ramakrishna Akurathi, learned Counsel for the Writ Petitioner, Sri M. Srinu Babu, learned Assistant Government Pleader for Municipal Administration & Urban Development, Sri B. Ramesh, learned Assistant Government Pleader for Revenue and Sri Potham Vengala Reddy, learned Standing Counsel for Municipal Corporation. 2. In compliance with the Order of this Court dated 23.04.2026, the Writ Petitioner herein has filed a Sworn Affidavit on a Rs.100/- Non-Judicial Stamp Paper, duly notarized, to the following effect: “I G. Indrani, W/o Late Chandra Sekhar Naidu, aged about 74 years, R/o. D.No. 12-5-526, Krishnadevaraya Nagar, Tilak Road, Tirupati - 517501. And I am the petitioner in Writ Petition No.11187 of 2026, on the file of the Hon'ble High Court, do hereby solemnly affirm and state as follows: I submit that after conducting survey, I filed appeal before the Deputy Inspector of Survey, Settlement & Land Records at Tirupati. As the survey was not properly conducted, I also approached the Tirupati Municipal Commissioner and submitted a representation dt: 22.04.2026, seeking three (3) months of time to remove alleged encroachment. If the portion of the building is demolished, the entire structure may also fell down as it is an old structure. I hereby undertake to remove the alleged encroachment portion within a period of four (4) weeks by erecting a support wall/pillar. I will abate aforesaid undertaking given by me.” 3. This Affidavit is filed by way of a Memo today i.e., on 24.04.2026 and the same is taken on record. 4. Sri Potham Vengala Reddy, learned Standing Counsel for Municipal Corporation submits that he has gone through the Affidavit. He would urge 3 that the time that is sought by the Writ Petitioner to remove the alleged encroachment of four weeks may be reduced to three weeks. 5. Having considered the contents of the Affidavit, this Court holds that the time sought by the Writ Petitioner of four weeks is just and reasonable. The Writ Petitioner shall strictly comply with the Undertaking given by way of this Affidavit dated 23.04.2026 and inform the Respondent-Corporation about the complete removal of the encroachment. If the Corporation is not satisfied about the compliance as per the Affidavit, it shall have the liberty to proceed with the removal/demolition of encroachment and recover such amount equal to 10 times of the expenditure incurred for such removal/demolition from the Writ Petitioner. 6. Having so recorded, this Court is of the view that no further consideration is necessary. 7. Accordingly, this Writ Petition stands disposed of. No order as to costs. 8.
