Since petitioner has remedy under Section 83 of Waqf Act, 1995 by way of approaching the Waqf Tribunal, therefore, this Court is not inclined to entertain the writ petition. (3) Mr. T.A. Khan, learned Senior Counsel appearing for Uttarakhand Waqf Board, points out that petitioner has approached the Waqf Tribunal by filing waqf petition. Writ petition is, accordingly, dismissed on the ground of alternate remedy with liberty to petitioner to move appropriate application in the pending waqf petition.
