2. Case of the prosecution, in brief, is that the complainant the Indranath Yadav lodged a report to the concerned Police Station alleging that on 02.12.2025 his father deceased Dasrath Yadav has stayed in the temporary cowshed constructed in a Badnijhariya Forest to look after and feed the buffalos. When the deceased didn't return home till next morning, a search was conducted and the deceased was found lying there dead after being electrocuted by a live wire connected to an electric pole for killing pigs. Before the incident the accused of the village had told the complainant that electric wires have been laid towards Badnijhariya Forest for hunting Wild Boars. But they were not informed about the electric current laid by them towards there cow shed. Based on this report police has registered the case against the applicant and other co-accused persons.
3.
Learned counsel for the applicant submits that the applicant is innocent person and he has been falsely implicated in this case and there is no evidence to show that applicant has laid down live wires for hunting of pigs, on the basis of suspicion and village politics complainant implicated the applicant. He would submit that there is no eye witness of the incident and nothing has been seized from the possession of the applicant. He would submit that the applicant is permanent resident of address shown in the above cause title and there is no chance of his absconding, the applicant is ready to furnish adequate surety and shall abide by all the directions and conditions, which may be imposed by this
3 Court, therefore he prays to enlarge the applicant on anticipatory bail.
4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail.
5. I have heard learned counsel for the parties and perused the materials available on record.
6. Considering the facts and circumstances of the case, nature and gravity of offence that the applicant along with co-accused, illegally laid live electric wires in the Badnijhariya Forest for hunting wild boars and the deceased died due to electrocution from the said live wire and the act was hazardous and resulted in loss of human life and also considering the fact that investigation is still going on, I am not inclined to grant anticipatory bail to the applicant.
7. Accordingly, the anticipatory bail application of the applicant - Sudeep Kumar Lakda, involved in Crime No.154/2025, registered at Police Station Kansabel, Distt. Jashpur (C.G.) for alleged commission of offence punishable under Section 105 of B.N.S. and Electricity Act is rejected. Sd/-Sd S S Sd/- (Ramesh Sinha)
