HON’BLE MR. JUSTICE PARTHIVJYOTI SAIKIA O R D E R 27.08.2026 Heard Mr. M. Khan, the learned counsel appearing for the petitioner. 2. This is an application under Article 227 of the Constitution of India challenging the order dated 22.07.2026 passed by the learned Civil Judge (Jr. Divn.) No.1, Cachar, Silchar in T.S. No.81/2015. 3. The petitioner is the defendant before the trial court. On 22.07.2026, the plaintiffs’ side was present with witnesses to be cross-examined by the defendant. But the defendant was absent without steps on that date. On the other hand, the plaintiffs submitted before the court that they will not examined any more witnesses in that case. Therefore, the trial court closed the cross-examination of PW.1 and listed the case on 31.08.2026 for argument. 4. The petitioner, now, submits that for certain reasons he could not be present on that date to cross-examine the PW.1. 5. I have considered the submissions of Mr. Khan. 6.
This Court is of the opinion that for the ends of justice, the petitioner should be given one opportunity to cross-examine PW.1. Therefore, the impugned order dated 22.07.2026 is set aside. The trial court is directed to provide one opportunity to the present petitioner/defendant to cross-examine the PW.1 on the next date. The plaintiff shall produce that witness for the purpose of cross-examination. With the aforesaid direction, the revision petition is disposed of. JUDGE Comparing Assistant
