Singh, Advocate For the Respondents : Mr. Shubham Gautam, AC to AAG-V ---------- 05/01.05.2026 In the instant writ application the petitioners have prayed for following reliefs: a) For quashing of the order contained in Memo No. 336 dated 10.06.2024 (Annexure -5) whereby and whereunder the claim of the petitioners for grant of minimum pay @ Rs. 16,290/ in the light of Resolution of Department of Finance issued vide Memo No. 660/F dated 28.02.2009 has been rejected on the ground that the same is applicable only for Assistant/Private Assistant of Jharkhand Secretariat although it provides for the grant of pay to the Government Servants appointed and joined prior to 2006 and working in State of Jharkhand which will include petitioners also. b) Upon quashing of the memo no. 336 dated 10.06.2024 further direction upon the respondents to determine and fix the entry pay (minimum pay) of the petitioners who have joined the service as Matric/Inter Trained Primary Teachers prior to 2006 as per revised scale contained in S-12 to the Annexure-1 of the fitment table contained in Resolution of Finance Department, issued vide Memo No. 660/F dated 28th February, 2009 published in Jharkhand Extra Ordinary Gazette i.e. in the initial pay of Rs. 16,290/ under 6th Pay Revision. c) For issuance of an appropriate writ(s)/Rule(S) /Order(S)/direction(s),or a writ in the nature of Mandamus, commanding upon & directing the respondents to fix the Entry Pay (minimum pay) of Rs. 16,290/ on 1st January 2006 in the unrevised pay scale Rs. (6500-10500/-) corresponding to the revised pay band PB II (9300-34800/-) with grade pay Rs.4200/- and to pay the arrears of salary and other consequential benefits after fixing minimum pay as Rs. 16,290/- on 1st January 2006 as per resolution vide Memo No. 660/F dated 28/02/2009 in the facts and circumstances of this case, for doing conscionable justice to the petitioners. 2. At the outset, learned counsel for the petitioners submits that the issues involved in this case have already been decided by this Court in W.P.(S). No. 5897 of 2014 and analogous cases, disposed of on 27.11.2025, which is annexed with I.A. No. 16938 of 2025. Accordingly, he submits that the instant writ application may be disposed of in the line of the said judgment. 3. Learned counsel for the respondents very fairly submits that issues involved in this writ application is same and similar with that of W.P.(S). No. 5897 of 2014 and analogous cases. 4. Having regard to the facts and circumstances of the case and fair submissions of Ld. Counsel for the rival parties coupled with the 2026:JHHC:13476 8 admitted position that the issue involved in the instant application is squarely covered by the judgment refereed to hereinabove, the instant writ application stands disposed of in the same line and on the same finding what has been given by this Court in W.P.(S). No. 5897 of 2014 and analogous cases. 5. Accordingly, the order contained in Memo No. 336 dated 10.06.2024 (Annexure-5), is quashed and set aside. The respondents are directed to extend the similar benefits what has been given to the petitioners of W.P.(S). No. 5897 of 2014 and analogous cases. 6. It has been contended by learned counsel for the respondents that they have already preferred appeal being LPA (Filing) No. 2694 of 2026 against the order passed by the Writ Court and as such, some protection may be given to the respondents. 7. Needless to say, the moment if the respondents will succeed in appeal which is pending before the Division Bench of this Court, certainly, the order passed in LPA will govern the case of these petitioners. 8. With the aforesaid observations and directions, the instant writ application stands disposed of. 9. Pending I.A. No. 16938 of 2025 also stands closed.
