1. Heard Ms. D. Hazarika, learned counsel for the applicant. Also heard Mr. A. R. Agarwala, learned counsel for the claimant/opposite parties. 2. This interlocutory application has been filed by the applicant/Insurance
Page No.# 3/3 Company in connection with MAC Appeal No. 203/2026 praying for stay of the execution of the impugned judgment and award dated 29.06.2024, passed by the Motor Accident Claims Tribunal, Dhubri, in MAC Case No. 146/2016 during the pendency of the connected MAC Appeal No. 203/2026. 3. The learned counsel for the applicant/Insurance Company has submitted that the applicant/Insurance Company is agreeable to pay 25% of the awarded amount as a condition for grant of stay of the impugned judgment and award during the pendency of the connected MAC appeal. 4. The learned counsel for the opposite parties/claimants does not have any objection with the same. 5. As such, notice to other opposite parties in this interlocutory application is hereby waived and this interlocutory application is allowed. 6.
The execution of the impugned judgment and award dated 29.06.2024, passed by the Motor Accident Claims Tribunal, Dhubri, in MAC Case No. 146/2016 shall remain stayed during the pendency of the connected MAC Appeal No. 203/2026, subject to deposit of 25% of the awarded amount by the applicant/Insurance Company before the Registry of this Court within a period of six weeks from the date of this order. 7. On such deposit being made, same may be disbursed to the claimant No. 1 by the Registry after proper verification. 8. With the above observation, this interlocutory application is disposed of.
