The present writ petition has been filed seeking a direction to the respondent/MCD to take action against the unauthorised construction raised by the private respondents no.3 and 4 over property bearing no.4581/52, Raigar Pura, Karol Bagh, New Delhi -110005 (hereinafter ‘subject This is a digitally signed order. The petitioner claims to be the owner of 1/24th share in the subject property on the basis of a preliminary decree dated 19th February 2026 passed by the District Court in CS DJ No. 620023/2016. 3. Mr. Rohit Kathuria, counsel appearing on advance notice on behalf of the respondent/MCD, submits that the basement to third floor of the subject property have been constructed pursuant to a sanction plan, a copy of which has been handed over to the counsel for the petitioner. 3.1 He submits that there is some unauthorised construction on the fourth floor of the subject property for which MCD shall take action in accordance with law. 4. Accordingly, the present writ petition is disposed of while directing the respondent/MCD to take appropriate action in accordance with law in respect of unauthorised construction on the fourth floor of the subject property. 5. Pending applications stand disposed of. 6. All rights, contentions and legal remedies of the owner/occupier/private respondents shall remain protected.
