The present petition has been filed by the petitioner with the following prayer:- “It is, therefore prayed that this Hon’ble Court may be pleased to allow this petition and quash the F.I.R. Dated 01.01.2024 & Charge-sheet Dated 27.08.2024 (P/1) in crime No.02/2024 for the offence under section 306 & 34 of IPC & under Section 3(2)(V) Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989at Police Station Sakti Bilaspur and further to quash the cognizance order Dated 13.09.2024 (P/2) passed by the Special Judge (Atrocities) Bilaspur, Chhattisgarh& further to quash the order Dated 24.09.2024 (P/3) of framing of charges in Special Session case (Atrocities) No. 31/2024, so far as it relates to the petitioner herein, in the facts and circumstances of the case and in the interest of justice.” 3. After arguing for some time, learned counsel for the petitioner seeks permission to withdraw the present petition and submits that the petitioner will cooperate in the trial. 4. Learned counsel for respondent No.2 states that the complainant and his family members whose evidence is to be recorded before the 3 trial Court shall appear before the trial Court on the next date fixed. 5. In view of the submissions made by the parties, the present petition is dismissed as withdrawn. The learned trial Court is directed to proceed with the trial of the case.
