JUSTICE D K SINGH) The present intra Court appeal has been filed impugning order dated 16.07.2025 in WP.No.14921/2015 passed by the writ Court. 2. The parties are referred to as per their ranking before the writ Court for the sake of convenience. 3. The petitioner has filed writ petition for the following reliefs: - 4 - HC-KAR NC: 2026:KHC:18079-DB WA No. 1463 of 2025 "(i) Issue a writ in the nature of certiorari or any other appropriate writ or direction quashing the Building Licence along with approved plan bearing Licence Sl. No.BBMP/CC/12794/24-25 dated 02.01.2025 issued by respondent No.4, produced as Annexure-X; (ii) Issue a writ in the nature of prohibition or any other appropriate order or direction against Respondent Nos.5 to 8 not to put up any further construction on property with Khata No.2824, in Sy. Nos.40, 41 and 30 in BBMP Ward No.150, Serenity Layout, Kaikondrahalli Village, Varthur Hobli, Bengaluru East Taluk, Bengaluru; (iii) Issue a writ in the nature of mandamus or any other appropriate writ or order or direction against Respondent No.2 to pass orders under Section 248(3), BBMP Act, 2020 for demolition of the illegal construction on property with Khata No.2824, in Sy. Nos.40, 41 and 30 in BBMP Ward No.150, Serenity Layout, Kaikondrahalli Village, Varthur Hobli, Bengaluru East Taluk, Bengaluru; (iv) Grant such other relief/s as this Hon'ble Court may deem fit in the circumstances of the case." 4. The dispute is regarding the ownership of the 6 guntas of land situated at Survey No.41 of Kailondrahalli Village, Varthur Hobli, Bengaluru East Taluk. The parties are already before the Civil Court in OS.No.2023/2011. - 5 - HC-KAR NC: 2026:KHC:18079-DB WA No. 1463 of 2025 The other suit has been filed by respondent No.5 in OS.No.7425/2022 for specific performance, the suits are still pending before the Civil Court. Until and unless the question of ownership is crystallised by the judgment and decree of the competent Court, the petitioner cannot seek removal or demolition of the alleged illegal construction by filing the Writ Petition before this Court. 5. The learned single Judge at paragraph No.10 of the impugned judgment has noted that in view of the report placed by the BBMP, the construction undertaken by respondent Nos.5 to 8 on disputed site was is in a strict compliance with the approved building plan and building licence issued by the Planning Authority. Therefore, question of invoking powers under Section 248(3) of the BBMP Act, 2020 would not arise. We are fully in agreement with the observation of the learned Single Judge. - 6 - HC-KAR NC: 2026:KHC:18079-DB WA No. 1463 of 2025 6. We do not find any ground to interfere with the impugned order passed by the learned Single Judge. Therefore, the writ appeal stands dismissed.
