Page No.# 1/2 GAHC010081992026 undefined THE GAUHATI HIGH COURT (HIGH COURT OF ASSAM, NAGALAND, MIZORAM AND ARUNACHAL PRADESH) Case No. : AB/869/2026 DEBASISH ACHARJEE S/O RAKHAL ACHARJEE, R/O LOCO COLONY, BUDDHA MANDIR, PS HOJAI, DIST HOJAI, ASSAM VERSUS THE STATE OF ASSAM TO BE REPRESENTED BY THE LEARNED PUBLIC PROSECUTOR, ASSAM Advocate for the Petitioner : MR SARFRAZ NAWAZ, MD A RAHMAN,SAMIM RAHMAN,MR. SURAJIT DAS,MR. A TARAFDAR Advocate for the Respondent : PP, ASSAM, BEFORE HONOURABLE MR. JUSTICE RAJESH MAZUMDAR ORDER Date : 25.08.2026 Heard Mr. A. Mishra, learned counsel for the petitioner. Also heard Mr. K.K. Parasar, learned Additional Public Prosecutor appearing for the State. The petitioner had been granted interim bail on 30.04.2026, observing that there does not appear to be anything connecting the present petitioner Page No.# 2/2 with the co-accused so as to attract Section 27A of the NDPS Act. The case diary, as called for, is yet to be submitted. In the circumstances, I am of the considered opinion that the interim bail granted to the petitioner can be made absolute, subject to the condition that the petitioner shall participate in and cooperate with the investigation process as and when required by the Investigating Authority. Failure of the petitioner to participate in the investigation process would entail recall/cancellation of bail. The anticipatory bail application stands disposed of. JUDGE Comparing Assistant
