The petitioner is apprehending his arrest in connection with Hussainabad P.S. Case No.223 of 2022, for the alleged offences registered under Sections 409, 420 and 272 of Indian Penal Code and Section 7 of Essential Commodities Act pending in the Court of learned S.D.J.M., Palamau. 3. Learned counsel appearing for the petitioner submits that the petitioner happened to be Assistant Godown Manager at Begampura Hussainabad FCI Godown. She further submits that duty of the petitioner starts once the goods kept in the said godown. She then submits that allegations are made of recovery of 55 bags of rice and 2 bags of wheat from a shop which was alleged to be of 2026:JHHC:14123 --2-- A.B.A. No. 2354 of 2026 the PDS scheme. She next submits that name of the petitioner has surfaced in the course of investigation and rice and wheat has been recovered from the possession of one Dribar Vijay Prasad. She also submits that transporter and agent have been granted anticipatory bail by this Court in ABA Nos.2146 of 2026. She next submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.05 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that name of the petitioner has surfaced in the course of investigation. 5. Considering that name of the petitioner has surfaced in the course of investigation and the petitioner is said to be Assistant Godown Manager at Begampura Hussainabad FCI Godown and recovery is said to be from the possession of one Dribar Vijay Prasad and transporter and agent have been granted anticipatory bail by this Court in the aforesaid ABA and the petitioner has got no criminal antecedent as disclosed in paragraph No.05 of the petition, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., 2026:JHHC:14123 --3-- A.B.A. No. 2354 of 2026 Palamau in connection with Hussainabad P.S.
