02/02/2026 M/L – 78 Court No.28 S. Kundu Rejected C.R.M.(A) 119 of 2026
In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Kaliachak P.S case no. 321 of 2016 dated 2/6/2016 under Sections 147/148/149/353/306 of the IPC. In the matter of: Alim Sk. ...Petitioner. Mr. Kazi M. Rahaman …for the petitioner. Ms. Sujata Das Mr. Sarthak Mondal …for the State.
1. Leave is granted to the petitioner to amend the cause title.
2. Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case. Charge-sheet has been submitted.
3. Learned counsel appearing for the State opposes the prayer for anticipatory bail. She submits that application for anticipatory bail of some others who were similarly circumstanced was rejected. Proclamation has already been issued. The petitioner has remained absconding since 2016.
4. Considering the above and the incriminating materials available in the case diary, the fact that the petitioner has remained absconding since 2016 and that proclamation has already been issued, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

5. Accordingly, the application for anticipatory bail is rejected.
