JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:16332 WP No. 27827 of 2023 ORAL ORDER The present writ petition is filed seeking the following prayer: "Wherefore the petitioners pray that this Hon'ble Court pleased to: (a) Direct the Respondent Bank to consider the representation dated 02.05.2023 vide annexure-F given by the petitioner for one time settlement of the loan liability as directed by this High Court in WP:34329- 331/2016 (GM-RES) vide ANNEXURE-A. (b) Direct the Respondent Bank to redeliver (Restore) the property to the petitioners which the Respondent Bank has taken physical possession vide order dated 17.07.2017 passed by the District Magistrate Shivamoga District in SMGDC.MAG(3) SARFAESI:CR/004/17-18(66705) vide annexure-G. (c) And grant such other order or direction as this Court deems fit to grant under the circumstances of the case in the interest of justice and equity." 2. There is no representation on behalf of the petitioners. 3. Learned counsel appearing for the respondent/bank submits that in this writ petition, the petitioners have questioned the sale notice and thereafter, another sale notice was issued and the bank had conducted the auction. Peitioner - 4 - HC-KAR NC: 2026:KHC:16332 WP No. 27827 of 2023 assailed the same before the Debt Recovery Tribunal by filing SA.No.301/2025 and the same is pending consideration. 4. In the light of the submission made by the learned counsel for the respondent/bank, nothing survives for consideration in this writ petition. Hence, this Court is passing the following: ORDER i.
