Applicant seeks regular bail in FIR No. 395/2025 registered at PS Mayur Vihar Phase-I for commission of offences under Section 109(1)/3(5) of BNS (corresponding Sections 307/34 IPC). 2. As per the prosecution story, the alleged incident had taken place on 13.09.2025 when the complainant party, including injured Rohit, were present inside a school premises after a cricket match. The accused party scaled the boundary wall of the school compound and entered inside and started abusing and threatening Rohit. 3. There are four accused persons, one of them is a juvenile offender. 4. As per the statement of injured Rohit, the juvenile offender had a stick in his hand whereas the co-accused Rajeev @ Khushi had a knife and, on the exhortation of juvenile offender, Rajiv had stabbed him Several times. 5. The role ascribed to the present applicant is to the effect that he was accompanying Rajiv @ Khushi, juvenile offender and one Akash. There is no specific role attributed to him, albeit, he was, as per the prosecution story, sharing a common intention. This is a digitally signed order. The applicant is in custody since 14.09.2025 and has, reportedly, no previous antecedents and charges have been framed and when the case was fixed for recording evidence of the complainant, the complainant did not appear and the case has now been adjourned to 28.09.2026 for PE. 7. The Nominal Roll of applicant has been requisitioned. 8. The age of applicant is found to be 28 years of age and as per Nominal Roll, his overall jail conduct is recorded as satisfactory and it also does not disclose any previous involvement. 9. Learned APP for State appears on advance notice and seeks to place on record status report. Taken on record. 10. Keeping in mind the overall facts and circumstances, albeit, without expressing any opinion over the merits of the case, applicant is hereby admitted to bail on his furnishing personal bond in a sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions:- (a) Surety would be local. (b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed. (c) Applicant/accused shall not come in contact of any witness, directly or indirectly. (d) The applicant/accused shall not leave NCR of Delhi, without permission of learned Trial Court. (e) The applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational all the time, till the disposal of the case. 11.
