2. This is an application filed under Section 483 of the BNSS, 2023 praying for grant of bail to the accused Mahidul Islam @ Mohidul Islam in connection with Barpeta Road Police Station Case No.72/2026 registered under Sections
Page No.# 2/2 179/180 of the BNS 2023 read with Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.
3. The learned counsel for the petitioner submits that the investigation has culminated in Charge Sheet No. 80/2023 dated 14.08.2023.
4. The learned counsel for the petitioner has submitted that since all material evidence has been collected and the charge sheet has been submitted, the petitioner may be allowed the privilege of bail at this stage and to participate in the trial as and when summoned.
5. The learned Additional Public Prosecutor has objected to the bail application. However, on consideration of the circumstances, I am of the view that the petitioner can be allowed the privilege of bail till the receipt of summons to face the trial.
6. Accordingly, it is directed that the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 20,000/- with a local surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Barpeta.
7. The petitioner shall, during the period of bail, not be involved in any offence of similar nature and shall not leave the jurisdiction of the learned Chief Judicial Magistrate, Barpeta, without obtaining prior written permission.
8. The petitioner shall appear before the Trial Court as and when summons are received and pray for regular bail. With the above observation and direction, the bail application stands disposed of. JUDGE Comparing Assistant
