learned counsel for the applicants- writ petitioners.
Page No.# 5/6 Also heard Ms. N. Bordoloi, learned counsel for the ONGC. By the present application, the applicants have prayed for an amendment in the writ petition to incorporate a prayer to put to challenge a communication dated
19.03.2024. It is the contention of the applicants that the said communication has already been annexed to the writ petition as Annexure F. However, there was no specific mention in the prayer portion. It is further submitted that since the communication has been issued by the Executive Director Chief Employee Relation ONGC, the said Officer is sought to be impleaded as respondent no. 4. Ms. Bordoloi, the learned counsel for the respondent nos. 1 and 2 has however raised objection by stating that in the meantime, affidavit-in-opposition has already been filed in the connected writ petition.She has also submitted that since the matter has come up for the first time, instructions may be allowed to be obtained. After hearing the learned counsel for the parties, this Court is of the opinion that the present application seeking an amendment will not cause any prejudice to the respondents in defending the case. This Court is also of the opinion that upon allowing the amendment, the respondents would be given a fair opportunity to file an additional affidavit, if so advised. In view of the above, the instant I.A. stands allowed permitting insertion of prayer no. 4 in the writ petition as indicated in the I.A. Further, the Executive Director Chief Employee Relation ONGC as mentioned above is allowed to be impleaded as respondent no. 4. Shri Das, the learned counsel assisting the learned Senior Counsel for the applicants is accordingly directed to file amended consolidated writ petition inserting the amendment as well as the respondent no. 4. Since the newly impleaded respondent no. 4 would be represented by Ms. Bordoloi, the learned counsel, no fresh notice is required to be issued.
