The Hon’ble Court may kindly be pleased to direct the respondent authorities to calculate and make the payment of gratuity to calculate and make the payment of gratuity to the petitioner with the interest of 18% per annum, pension & leave encashment also. 10.2. The Hon’ble Court may kindly be pleased to grant any other relief which this Hon’ble Court deems fit and proper in favour of the petitioner as per the facts & circumstance of the present case, in the interest of justice.” 2. Learned counsel for the petitioner submits that the petitioner was working as Joint Commissioner, Panchayat and Rural Development Department of Government of Chhattisgarh and he retired on attaining the age of superannuation on 30.04.2016. He also submits that a criminal case was pending against the petitioner, therefore, his retiral dues were withheld by the respondent authorities. Vide its order dated 14.10.2024, the learned Special Judge(Prevention of Corruption Act) and First Additional Session Judge, Uttar Bastar, Kanker in Special Criminal (P.C. Act) Case No. 02/2016, acquitted the petitioner from all the charges leveled against him. He would further submit that as the petitioner is now acquitted, there is no impediment upon the respondent authorities to pay the retiral dues to the petitioner. Therefore, this writ petition may be disposed of with a direction to the respondent authorities for payment of retiral dues. 3. Ms. Shukla, learned Government Advocate on instruction submits that the retiral dues of the petitioner viz pension, gratuity amount and leave encashment etc. has been sanctioned and duly paid to the petitioner. She placed on record the documents to indicate the same and would submit that the documents placed on record has also been communicated to the petitioner. 3 4. In view of the above, this writ petition is disposed of at this stage, reserving liberty in favour of the petitioner to file a fresh writ petition in case any cause of action still survives or any other retiral dues remain unpaid.
