Petitioner seeks enforcement of Kashmir Chand Versus HRTC and Ors.2. Operative portion of the decision is as under:-
“5. In view of above, this writ petition is allowed. The impugned direction No.5 of the impugned office
order dated 01.08.2015 (Annexure P-4) is quashed and set aside. Respondents/Competent Authority is directed to consider the case of the petitioner and pass order in accordance with law for payment of due and admissible back wages/arrears to him from the date of his compulsory retirement w.e.f. 17.04.1998 till 01.08.2015 (the date of his reinstatement pursuant to office dated 01.08.2015) keeping in view the observations made above.
The DCRG, which is due to the petitioner, shall also be paid to him after offsetting/adjusting the

recovery, if any, to be effected from the petitioner on account of payment made to him consequent upon penalty of compulsory retirement previously imposed upon the petitioner. This exercise be carried out within three weeks from today and the revised financial/retiral benefits due and admissible to the petitioner, be also paid to him within the aforesaid period.”

Learned counsel for the respondents places on record copy of office letter dated 16.06.2026 to the effect that consequent upon pay fixation of the petitioner, a retired Conductor, the arrears/back wages payable to him have been worked out and assessed at Rs.25,97,796/-.
Learned counsel submits that the respondents are already in the process of releasing the above assessed arrears/back wages to the petitioner; It shall be ensured that payment admissible to the petitioner is released in his favour within two weeks from today, i.e. by or before 14.07.2026.
Taking note of the office letter dated 16.06.2026 and the assurance given by learned counsel for the respondents on the basis of instructions imparted to him, this execution petition to stand disposed of with direction to the respondents to release the admissible payment to the petitioner, which is otherwise their liability and obligation in terms of the decision rendered in Kashmir Chand2, by or before 14.07.2026. Liberty is, however, reserved to the

petitioner to seek appropriate remedy for the redressal of his surviving grievances, if any, in accordance with law.
