PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to quash the proceedings against the Petitioners/Accused Nos.1 to 5 in Cr.No.37 of 2024 on the file of Uyyalawada Police Station, Nandyal District, for the alleged offences punishable under Sections 324, 450 and 109 of the Indian Penal Code, 1860 (for brevity, ‘the I.P.C.,’) and Section 156 (3) of ‘the Cr.P.C’. 2. Heard learned counsel for the Petitioner and learned Assistant Public Prosecutor. Perused the record. 3. As seen from the record, the Respondent No.2 filed a private complaint, which was referred by the Jurisdictional Magistrate, Koilakuntla, for registration of Crime No.37 of 2024 for the alleged offences punishable under Sections 324, 450 and 109 of the I.P.C’. In the course of investigation, it was revealed that the complaint of the Petitioner was false. The Sub-Divisional Police Officer, Allagadda, Nandyal District, granted permission to refer the case as ‘false’. 3
4. Sri A.Sai Rohith, the learned Assistant Public Prosecutor submits that the matter is now pending for issuance of RCS proceedings, after issuing notice to the de-facto complainant in the crime. 5.
Mrs.Sodum Anvesha, the learned counsel for the Petitioners submits that when Petitioner No.2 applied for a passport, a communication dated 11.03.2026 was received from the Ministry of External Affairs, Regional Passport Office, Vijayawada, stating that an enquiry revealed that a case is pending before the Jurisdictional Magistrate, Koilakuntla. 6. Having regard to the facts and circumstances of the case, the learned Jurisdictional Magistrate, Koilakuntla, is directed to expedite issuance of RCS proceedings in accordance with law, within a period of one (01) month from the date of receipt of this order. 7.
