The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 25.05.2026 passed by Sessions Judge, Gautam Buddha Nagar in Criminal Appeal No. 8 of 2026, in Complaint Case No. 1296 of 2025, wherein the appellate Court observed that since the order dated 23.01.2026 has been kept in abeyance by this Court vide order dated 10.03.2026 in Application U/S 482 No. 9222 of 2025, it will not be appropriate to proceed the case further. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty. Disconnect the connected file of Application U/s 528 of BNSS No. 9222 of 2025.
