Order 11/08/2026
Learned counsel for the petitioner has relied upon the order dated 26.05.2026 passed in SBCWP No. 9228/2026 titled as Kalu Ram Vs. Rajasthan Staff Selection Board. Relying upon the same, counsel submits that the petitioner had applied for the recruitment on the post of Livestock Assistant, pursuant to advertisement dated 11.12.2024. It is submitted that under the Rights of Persons with Disabilities Act, 2016 his physical disability
[2026:RJ-JP:31471] (2 of 2) [CW-13117/2026] for vision was calculated at 42 percent. However, as per the Medical Board report dated 16.04.2026, his disability was counted at zero percent. By way of the present petition, he has prayed for the constitution of a medical board on account of the great discrepancy, which is not acceptable to him. Heard. Issue notice. On directions of the Court, Ms. Supriya Rana on behalf of Ms. Minakshi Jain, GC and Mr. Yash Joshi accept notice on behalf of the respondents. Considering the ratio of the judgment referred above and the wide discrepancy between both reports, this Court deems it appropriate to dispose of the writ petition with a direction that if Rs.10,000/- be deposited in favour of the competent authority, SMS Hospital, Jaipur, a fresh medical board shall be constituted, consisting of persons other than those who were members of the erstwhile medical board. The medical board so constituted, may conduct the required tests or physical analysis of the petitioner and submit their report within 15 days to the respondent RSSB. The petition is disposed of with the above observations. Pending applications, if any, stand disposed.
