ORDER 28-08-2026 Heard Mr. S. Dutta, learned Senior Counsel assisted by Mr. S. H. Rahman,
learned counsel for the applicant and Mr. K. Baishya, learned Additional Public Prosecutor, Assam.
2. This interlocutory application has been filed by the applicant seeking extension of interim bail passed in AB No. 1122/2025 passed by this Court vide its order dated 18.03.2026.
3. It is submitted by Mr. Dutta, learned Senior Counsel that vide order dated 18.03.2026, this Court had directed the present applicant/petitioner to appear before the learned Trial Court seeking regular bail within 15 (fifteen) days from the date of the order and the interim bail was accordingly exended to that period.
4. However, there was no communication from the counsel, who appear before this Court and as such, the applicant/petitioner was not aware about the direction passed by this Court, whereby he was directed to appear before the learned Trial Court within 15 (fifteen) days from the date of the said order dated
18.03.2026. However, after coming to know about the order, he also tried to communicate with his counsel, but he was not properly advised by his engaged counsel and thus, he could not even comply with the order of this Court, nor he could approach this Court after 15 days from 18.03.2026. However, the present
Page No.# 4/4 petition is filed in the month of July, 2026 before this Court, but due to non- availability of the Bench, the matter was not put up before this Court.

Further, Mr. Dutta, learned Senior Counsel submitted that the applicant/petitioner is ready and willing to appear before the learned Trial Court as per direction of this Court and in that context he only prayed for 7 (seven) days extension of the earlier interim bail granted to the present petitioner vide
order dated 18.03.2026.
6. Mr. Baishya, learned Addl. PP raised objection and submitted that the order was passed by this Court on 18.03.2026 and till July, 2026, the present petitioner did not take any step to appear before the learned Trial Court.
7. Considering the submission made by the learned counsel for the parties, the explanation made in the present petition and other aspects of the case, the present interlocutory application is hereby allowed with a direction to the present applicant/petitioner to appear before the learned Trial Court strictly within a period of 7 (seven) days from the date of order with a regular bail application, which may be considered in accordance with law.
8. This interlocutory application accordingly stands disposed of.
