Petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon’ble Court may kindly be pleased to issue writ in the nature of mandamus directing respondent authorities to give petitioner weekly off from date of appointment till date and duty discharged by petitioner on Gazetted Holidays excluding the 30 days leave encashment per year. Further respondent authorities may be directed to give petitioner salary for the 12-16 hours duty served instead of 8 hours from period date of appointment till date of retirement. 10.2 That this Hon’ble Court may be further pleased to direct respondent authorities to pay the litigation expense which he incurred. 10.3 That this Hon’ble Court may be further pleased to pass any other consequential and other orders/writs which this Hon’ble Court deems just and proper in the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that petitioner was holding the post of Constable in Central Industrial Security Force, SECL Bilaspur. Petitioner has worked over time and has also discharged his duties during gazetted holidays. However he was not being paid the remuneration for over time as also for his duty on gazetted holidays, even after making oral request. Petitioner being aggrieved had submitted a representation Annexure P-4 vide order dated 12.01.2026 which till date is still pending for consideration, therefore, direction be issued to respondent authorities to take decision on representation submitted by petitioner at the earliest within a specified time frame. 3 / 3 3. Learned counsel for State submits that as petitioner is not pressing this writ petition on merits and is only seeking direction to respondents authorities to take decision on pending representation, he is having no objection, if representation is still pending consideration, it will be considered and decided in accordance with law at the earliest. 4. On due consideration of submission made by learned counsel for the respective parties, nature of grievances raised and in particular the submission made by learned counsel for petitioner that the representation Annexure P-4 is still pending consideration before respondents, without entering into merits of the case, writ petition at this stage is disposed of, directing respondents to consider and take decision on representation submitted by petitioner dated 12.01.2026, in accordance with law, expeditiously, preferably within a further period of two months from the date of receipt of the order. It is ordered accordingly. 5. Petitioner will be at liberty to submit fresh representation before the respondents if he so desires, and if such a representation is submitted by petitioner, concerned respondent authorities shall also consider and take decision on the representation to be submitted by petitioner along with the pending representation. 6.
