A show cause affidavit dated 04.02.2026 has been filed on behalf of the opposite party nos. 3 and 4. 3. On perusal of paragraph-6 of the said show cause affidavit, it appears that an amount of Rs. 10,25,531/- has been paid to the petitioner under the head of arrears of salary, arrears of pension, difference of Gratuity and difference of leave encashment. It has further been averred in paragraph-7 of the said show cause affidavit that pursuant to the pay fixation, the arrears of salary for the period from 30.04.1986 to 31.12.1995, 01.04.2000 to 31.12.2005 and from 01.04.2010 to 31.12.2015 have been paid. It has also been mentioned in the said paragraph that the gap in payment is due to non-availability of contribution of the Central 2026:JHHC:15046 2 Government which started from 5th Pay Commission with effect from 01.01.1996 and, therefore, the same shall be paid only on receipt of the amount for the said period for which a communication has already been made to the State Government vide letter dated 28.01.2026 (a copy of the said communication has been annexed as Annexure-B to the said affidavit). As per the said letter, the arrears of salary on revision for the said period has been calculated as Rs. 9,89,319/-. 4. Having heard learned counsel for the parties and considering that part compliance has already been made by the opposite parties, there is no need to further proceed in the contempt petition. The contempt proceeding as against the opposite parties is hereby dropped. 5. The contempt petition is accordingly disposed of. 6. It is, however, made clear that if the payment as mentioned in the letter dated 28.01.2026 is not made to the petitioner within one month from today, the petitioner will be at liberty to prefer a fresh contempt petition against the opposite parties. It is also observed that the Director, Directorate of Higher Education, Department of Higher and Technical Education, Government of Jharkhand (opposite party no. 2) shall fully co-operate with the Sido-Kanhu Murmu University to ensure payment of the said amount to the petitioner within the aforesaid period.
