Also heard Mr. K K Das, the learned Additional Public Prosecutor for the State of Assam and Mr. Darak Ullah, the learned Amicus Curiae appearing for the respondent No.2. 2. Mr. Das has objected to this bail application. 3. This is an application under Section 482 of the BNSS, 2023, in respect of Sessions Spl. POCSO Case No. 89/2025 pending in the court of the learned Additional Sessions Judge- cum-Special Judge (POCSO), Golaghat, Assam. 4. The petitioners, namely, 1. Rubul Bora, 2. Abinash Kakoti, 3. Luken Saikia & 4. Suresh Bora have been shown as absconders in the charge sheet. 5. The learned counsel for the petitioners submits that the petitioners are interested in facing the trial and therefore, they may be given adequate opportunities to that effect. 6. I have considered the submissions made by the learned counsels of both sides. 7. Since the petitioners are interested in facing the trial, they deserve to be given adequate opportunities to that effect. Therefore, their pre-arrest bail application is allowed. 8. It is hereby directed that the petitioners shall appear before the Court of the learned Additional Sessions Judge-cum-Special Judge (POCSO), Golaghat in connection with Sessions Spl. POCSO Case No. 89/2025 within next 7 (seven) days from today and on their appearance, the petitioners, namely, 1. Rubul Bora, 2. Abinash Kakoti, 3. Luken Saikia & 4. Suresh Bora shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge (POCSO), Golaghat, Assam.
