Grievance raised by petitioner-City Union Bank is that proceedings in S.A.No.369 of 2024, filed by respondent No.2 (Guarantor), are not being completed by learned Debts Recovery Tribunal (for brevity “DRT”), despite all pleadings having been completed in the year 2024. An application seeking vacation of interim order passed in favour of private parties was also filed by Bank on 07.10.2024, but said application is also pending, thus lending grave prejudice to petitioner, who is unable to proceed with the matter under Securitization and Reconstruction of 2 Financial Assets and Enforcement of Security Interest Act, 2002(for brevity “SARFAESI Act”) against the borrower/guarantor. 2. Having heard learned counsel for petitioner Bank, we do not find any ground to interfere in this petition at this stage. It is always open to petitioner Bank to approach learned DRT with appropriate application for expediting proceedings. In case such an application is filed, we are sanguine that the same shall be entertained and necessary action be taken by learned DRT keeping in view the specific mandate under SARFAESI Act. 3. Writ Petition is disposed of accordingly. No order as to costs. Pending applications, if any, are disposed of accordingly.
