The petitioners are apprehending their arrest in connection with Gumla PS Case No.70 of 2026, for offence registered under section 115(2), 126(2), 351(2), 324(4), 308(2)/3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Gumla. 3. Learned counsel for petitioners submits that the petitioners have purchased the land from one Paswan Kumar son of Anirudh Lal Sahu bearing plot no.1125, area 4.01 acres and plot no.1126, area 0.46 acres of Khata No.117 situated at Village Dumardih vide sale deed dated 24.11.2022 and said land was also mutated vide Mutation Case no.1525 of 2022-23 and the petitioner are in peaceful possession over the said land. She submits that false allegations are made by the informant that the petitioners had tried to dig the said land and demanding Rs.50,000/-. She also submits that the petitioners have got no criminal antecedent as disclosed in paragraph 2026:JHHC:13469 2 no.17 of the petition. She next submits that for the said dispute, one case is also pending before the Sub Divisional Magistrate Gumla being Miscellaneous Case No.34 of 2022-23. 4. Learned State counsel opposes prayer and submits that allegations are there of digging the said land. 5. Annexure-2 are the documents relating to the sale deed and mutation which prima facie suggest that the petitioners have purchased the said land and they were in peaceful possession over the said land and dispute is there with regard to possession and for that, one case is pending before the Sub Divisional Magistrate, Gumla, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before learned court within two weeks from today, and in event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to the satisfaction of learned Chief Judicial Magistrate, Gumla, in connection with Gumla PS Case No.70 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
