Invoking section 483 BNSS, the petitioners are seeking regular bail in connection with Boginadi PS Case No. 82/2026 under section 61(2) BNS read with Section 13(1) (a) of the Assam Cattle Preservation Act, 2021. 3. Both the petitioners were arrested on 03.08.2026. 4. The case arose out of an FIR dated 03.08.2026 lodged by one Abhijit Gogoi. It is alleged that an information was received about carrying of beef meat and thereupon, the police personnel went out in civil dress. Subsequently, the two petitioners were found in the bike bearing registration No. ASO7T4143 and upon being apprehended 11.602 kgs of beef in 11 black colour polythene bags were found and seized. 5. It appears from the FIR and is also submitted by the learned counsel, one of the petitioners is from Kamley district of Arunachal Pradesh and the other petitioner is from Lakhimpur district of Assam. The investigation will have to determine whether the alleged act of the petitioners are in violation of the Assam Cattle Preservation Act, 2021. 6. Nevertheless, I am of the considered view that bail can be considered at this stage, though the learned Additional PP has opposed to the same contending that considering the quantity, it is suspected that the beef meat was for sale in the area. 7. Accordingly, in the given facts and circumstances, the petitioners are allowed to go on bail on furnishing a bail bond or Rs.
25,000/- (twenty five thousand) each with one surety each to the satisfaction of the learned CJM, Lakhimpur and subject to the conditions that :-
Page No.# 3/3 (i) they shall cooperate with the investigation; (ii) they shall not hamper or tamper with evidence; (iii) they shall not commit any activities violative of Assam Cattle Preservation Act and Prevention of Cruelty to Animals Act. 8.
