The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No. 457/2025, registered at Police Station - Abhanpur. District- Raipur (C.G.) for alleged commission of offence punishable under Section 20 (B) of Narcotic Drugs and Psychotropic Substance Act.
2. The case of the prosecution in brief is that it is alleged that the Police Station Abhanpur, District Raipur, received a secret KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 information from an informant on 14.12.2025 that, in village Gotiyardeeh, Uparapara Road, near Dabri, a person was searching for customers to dispose of illegal contraband (ganja). Thereafter, the police team rushed to the spot and the co-accused, namely Ghanshyam Pahadi, was searched, from whose possession about 990 grams of contraband (ganja) was seized. Thereafter, based on the statement of the co-accused Ghanshyam Pahadi, the present applicant has been implicated in the instant crime.

Learned counsel for the applicant submits that the present applicant has been falsely implicated in the aforesaid case and has not committed any offence. It is further submitted that the applicant is a retired constable and in the event of his arrest, he shall suffer irreparable loss. It is also contended that the implication of the applicant is solely based on the memorandum statement of the co- accused, which has no evidentiary value in the absence of any corroboration. The applicant undertakes to abide by all such terms and conditions as may be imposed by this Court while granting anticipatory bail.
4. On the other hand learned State counsel opposes the application for grant of anticipatory bail to the applicant.
5. Recently the Supreme Court in the matter of Anarul SK v. The State of West Bengal {SLP (Crl.) No(s). 12621/2024 has observed that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue.

6. In the light of observation made by the Supreme Court in Anarul SK (supra), I do not find any good ground to entertain this anticipatory bail application. Accordingly, the present anticipatory bail application is dismissed. Sd/- (Ramesh Sinha)
