The present application under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicans to quash the entire proceedings of Special Case No. 1011 of 2026, arising out of case crime No. 643 of 2024, under Sections 137(2), 65(1), 87, B.N.S. and Section 5L/6 of Protection of Children from Sexual Offences Act, Police Station- Cantt, District Gorakhpur as well as cognizance/summoning order dated 21.4.2026, pending in the court of Special Judge (POCSO Act)/Additional Sessions Judge, Court No. 3, Gorakhpur. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file appropriate application/proceedings before the court of competent jurisdiction. The instant application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
