JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed the sole accused under Section 482 of BNS praying to grant anticipatory bail in Crime No. 472/2025, of Kolar Rural Police Station, registered for offences under Section 121(1), 132, 352 of BNS. 2. Heard the learned counsel for petitioner and learned HCGP for respondent/State. 3. Learned counsel for the petitioner would contend that when the petitioner boarded the bus and he gave Rs.30/- for ticket and conductor insisted him to give correct change of Rs.22/- which is the ticket fare. At that time there was quarrel that took place between petitioner and the conductor. The petitioner is ready to co-operate with the police in investigation and abide by any terms and conditions to be imposed by this Court. The offence alleged are triable by Magistrate and not punishable either - 3 - HC-KAR NC: 2026:KHC:10966 CRL.P No. 32 of 2026 with death or imprisonment for life. With this, he prayed to allow the petition. 4. Per contra, learned HCGP would contend that the petitioner has assaulted the Conductor who is a public servant while discharging his duties. The petitioner has assaulted the Conductor, as he asked him to take bus ticket. The petitioner has assaulted the Conductor with bracelet on his face and caused bleeding injury. The wound certificate indicates that the injured sustained two simple injuries. The investigation is in progress. The statement of eye witnesses by name Naresh Yadav, Balakrishna Naidu and Ramanji, has been recorded. They have stated regarding the acts of this petitioner assaulting the Conductor when he asked the petitioner to take bus ticket. The petitioner is required for custodial interrogation. With this she prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused FIR, complaint and other materials placed on record. - 4 - HC-KAR NC: 2026:KHC:10966 CRL.P No. 32 of 2026 6. The allegation in the complaint against this petitioner is that when the Conductor insisted the petitioner to take bus ticket, at that time, he assaulted him on his face with bracelet and caused injuries. The petitioner is stated to have told the Conductor that he is a person on hearing his name, entire BTM layout will crumble and so saying, he has assaulted the Conductor with a bracelet on his face and caused bleeding injuries. On perusal of the wound certificate, the Conductor has sustained two injuries below his right eye and there was redness present at the right eye. The petitioner has obstructed the public servant in discharging his duties and assaulted him. There are three eyewitnesses namely Naresh Yadav, Balakrishna Naidu and Ramanjinappa and their statements are recorded. They have stated the acts of this petitioner assaulting the Conductor when he asked him to take bus ticket. - 5 - HC-KAR NC: 2026:KHC:10966 CRL.P No. 32 of 2026 7. Considering the said aspect, the petitioner has not made out any case for grant of discretionary relief of anticipatory bail. In the result the petition is dismissed.
