This is the second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 120/2024 registered at Police Station Lailunga, District – Raigarh (C.G.), for the offence punishable under Section 307 of the Indian Penal Code. 2. The earlier bail application of the applicant has been rejected by this Hon’ble Court vide order dated 16.12.2025 passed in MCRC No. 9246 of 2025 on merits. 3. 2 place wherein the complainant, namely Chano Lakra, alleged that her daughter-in-law, Ms. Fulkumari Lakra, was attacked on her head with a farming tool (tangi) by the applicant, Niranjan Jakra. It is further alleged that the applicant struck the victim twice on her head with the said farming tool. 4. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that this is the second bail application of the present applicant, and that the complainant (PW- 01), namely Chano Lakra, and the victim (PW-02), namely Fulkumari Lakra, have been examined before the learned Trial Court. During their chief examination, they failed to support the prosecution case and have been declared hostile. He also submits that the applicant has no criminal antecedents and has been in custody since 26.05.2024, and that the conclusion of the trial is likely to take some time. Therefore, he prays for grant of regular bail to the applicant
5. Learned counsel appearing for the State/non-applicant would oppose the bail application of the applicant. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7.
Considering the aforesaid submissions, and the allegations that the applicant assaulted the victim with a farming tool (tangi) causing injuries on her head, this Court is of the view that merely because the complainant and the victim have turned hostile, the same cannot be a ground for releasing the applicant on bail. Therefore, this Court is not inclined to grant regular bail to the present applicant. 8. Accordingly, the second bail application of the applicant - Niranjan Lakra, involved in Crime No. 120/2024 registered at Police Station
