Heard Shri Rajeev Shrivastava, Sr. Advocate along with Shri Akhand Pratap Pandey, Advocate, learned counsel for the petitioners, Shri Shashank Thakur, Deputy, Advocate General for the State/Respondent No.1 & Shri Harshwardhan Parganiha, Advocate for the Respondent No.2. 2. The present petition has been filed by the petitioner with the following prayer(s): “(i) Quash and set aside the impugned order of cognizance dated 11.11.2022 and order dated 22.03.2024passed by the learned Judicial Magistrate First Class, Raipur, in Criminal Case No. 15617/2025. (iii) Quash the charge sheet No. 232/2022 arises from FIR No. 166/2022 dated 09.06.2022 registered under Sections 120B and 420 of the Indian Penal Code, at police station Azad Chowk Raipur District Raipur (C.G.) (iv) Consequently, quash and set aside the entire criminal proceedings in Criminal Case No. 15617/2025 arising out of FIR No. 166/2022, between the parties (state of CG V/S Swapnil Mittal and others) pending before the learned Judicial Magistrate First Class, Raipur District Raipur (C.G.) (v) Pass such other and further orders as this Hon'ble Court may deem fit, proper, and just in the facts and circumstances of the case” 3 3. Learned Senior Counsel for the petitioner would submit that in the present matter, the matter has been compromised between the petitioners and the respondent No.2 and the amount in question has already been paid by the petitioners to respondent No.2 and stated that besides the present FIR there appears to be seven more FIR and out of which excepting one, in other cases the compromise has taken place between the parties and though the Complainant in the said cases are different persons. He submits that he proposes to file the petition for quashing of the same on the ground of compromise between the parties in the said cases also. 4. Learned counsel for the respondents also admits the submission made on behalf of the petitioners and confirms the factum of the compromise. 5. We have heard learned counsel for the parties. 6. Considering the facts of the matter and compromise has taken place between the parties and an application cannot be moved because the proceedings are pending before this Court. They are directed to appear before the trial Court concerned and move an appropriate application under the relevant provisions of law. The learned trial Court shall verify the genuineness of the compromise and pass necessary orders in accordance with law. 7. In view of the above, the present petition stands disposed off.
