Learned counsel for the petitioner submits that the petitioner is in custody in connection with Bano P.S. Case No. 09/2025 corresponding to POCSO Case No. 09/2025 for the offence registered under Section 70(2) of BNS and Sections 4, 6 & 10 of POCSO Act, now said to have been pending in the court of learned Special Judge (POCSO), Simdega. 2. The FSL report in sealed cover has been produced by the prosecution before this Court. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he is not named in the FIR. He has further submitted that he has been made accused on the basis of confessional statement of the co-accused. 4. Learned counsel for the opposite party has opposed the prayer and has submitted that it is a case of gangrape. The victim is 14 years of age. 5. After hearing the learned counsel for the parties and considering the serious nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Hence, this bail application is rejected. 6. However, the report, which has been received from the FSL, is directed to be sent by the registry to the court concerned through special messenger and the same be appropriately placed on record of the connected case by the learned presiding officer of the court. 2026:JHHC:14709 2 7. A photocopy of the DNA report be placed on record of this case and original as received be sent to the concerned court . 8.
