(Oral) Pursuant to notices issued in the instant proceedings, Mr. Akshay Kumar Bhatt, Tehsildar Nanital, District Nanital, Uttarakhand has come present before this Court. He states that though on account of heavy workload, comments as called for by the jail authorities could not be furnished earlier. However, same have now been furnished to Director General (Prisons) & Corrections Services, Himachal Pradesh. 2. Mr. Rajan Kahol, learned Additional Advocate General, who has now been instructed to appear on behalf of for respondent No.4, states that on receipt of comments, prayer made on behalf of the petitioner for parole has been rejected vide order dated 23.06.2026. Since petitioner is a permanent resident of Nepal, District Magistrate, has not recommended the temporary release of the aforesaid convict because there is a possibility of his absconding to Nepal and and as such, he is not considered fit to be released on parole. 3. Faced with aforesaid developments, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file afresh, laying therein challenge to order dated 23.06.2026.
