3. Heard learned counsel for the parties.

This is the First Bail Application moved on behalf of the Applicant seeking regular bail in connection with FIR/Case Crime No. 616 of 2025, for the offence punishable under Sections 8(c)/21(b)/60 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as the “NDPS Act”), registered at P.S. Pathri, District Haridwar.
5. It is argued by learned counsel for the Applicant that the Applicant has been falsely implicated and is languishing in jail since 14.11.2025. It is further submitted that he has no criminal antecedents. Learned counsel further submits that nothing has been recovered from the possession of the Applicant and that the mandatory provisions of the NDPS Act have not been complied with. It is also submitted that a total of 31 strips of Dicyclomine HCL, Tramadol HCL and Acetaminophen have allegedly been recovered, each strip containing 24 capsules, amounting in all to 744
capsules, and that the same is below the commercial quantity.
6. Learned State Counsel opposed the bail application; however, he admitted the fact that the alleged contraband is below the commercial quantity.
7. Considering the facts and circumstances of the case, without expressing any opinion as to the final merits of the case, this Court is of the view that the Applicant deserves bail at this stage.
8. The Bail Application is allowed.
9. Let the Applicant be released on bail upon executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
10. All pending applications, if any, stand disposed of.
